Sexual Assault
Sexual assault is a crime that will not be tolerated; it impedes a unit or members' morale effectiveness, efficiency, and impairs the ability of the Marine Corps to function smoothly. It is an unthinkable crime that victimizes irrespective of gender, race, or age. It not only undermines unit trust and confidence vital to mission accomplishment, it threatens to tarnish the honor of Corps.

Definitions
Sexual Assault is defined as intentional sexual contact, characterized by use of force, threats, intimidation, abuse of authority, or when the victim does not or cannot consent. Sexual assault includes rape, forcible sodomy (forced oral or anal sex), and other unwanted sexual contact that is aggravated, abusive, or wrongful (to include unwanted and inappropriate sexual contact), or attempts to commit these acts.
Consent - A freely given agreement to the conduct at issue by a competent person. An expression of lack of consent through words or conduct means there is no consent. Lack of verbal or physical resistance or submission resulting from the use of force, threat of force, or placing another person in fear does not constitute consent. A current or previous dating or social or sexual relationship by itself or the manner of dress of the person involved with the accused in the conduct at issue shall not constitute consent. A sleeping, unconscious, or incompetent person cannot consent.
Rape is sexual intercourse, against a person’s will or without their consent.
Forcible sodomy, is oral or anal sex without a person’s consent.
Unwanted sexual contact grabbing, fondling, or touching someone in a sexual manner without their consent.
Impaired is being in a less than perfect or whole condition such as disabled or functionally defective, or intoxicated by alcohol.
Reporting Options
Restricted – the command is made aware of an incident being reported but does not know any details of the incident (to include the victim’s name, unit, or gender); an investigation is not initiated and the attacker is not pursued. A Restricted report can be changed to an Unrestricted report at any time the victim chooses.
Unrestricted – the command is made aware of an incident being reported and knows all details (to include the victim’s name, unit, and gender); an investigation is initiated and the attacker is pursued. An Unrestricted report can never be changed to a Restricted report.
